GENERAL TERMS AND CONDITIONS

for the rental of vehicles and other items by “EasyRentBulgaria” Ltd.

I. GENERAL PROVISIONS

1. These General Terms and Conditions govern the relationship between “EasyRentBulgaria” Ltd., UIC 202163172, hereinafter referred to as “EasyRent”, and persons who request, enter into and/or perform a rental agreement for a vehicle or other item offered by EasyRent.

2. Correspondence with EasyRent shall be carried out at: Sofia, 11 Brussels Blvd., Building B – ground floor, showroom; telephone: +359 (0) 889 999 179; e-mail: [email protected]; as well as by any other means specified at https://easyrentbulgaria.bg/.

3. For the purposes of these General Terms and Conditions, the following terms shall have the meanings set out below:

A) “General Terms and Conditions” – these General Terms and Conditions for the conclusion and performance of rental agreements for vehicles or other items offered by EasyRent.

B) “Individual Agreement” – the vehicle rental agreement concluded between EasyRent and the Renter. The General Terms and Conditions form an integral part thereof. In the event of a conflict, the Individual Agreement shall prevail.

C) “Renter” – a natural person who requests, enters into and/or performs a rental agreement for a vehicle or other item offered by EasyRent.

D) “Driver” – the natural person who will drive the rented vehicle. Where different from the Renter, the Driver’s details shall be entered in the Individual Agreement. Only one additional Driver may be registered. The obligations of the Renter applicable to the driving and use of the vehicle shall also apply to the Driver.

E) “International Driving Permit” – a document certifying the right to drive in accordance with the applicable international treaties and national legislation.

F) “Vehicle Classes” – categories based on technical characteristics, size, equipment and market segment: economy, intermediate, large, estate, premium, minivan, luxury, special and SUV/4x4. The specific classification is indicated on the EasyRent website or on the partner platform.

G) “Vehicle of a Similar Class” – a vehicle of the same or a comparable class, with the same or similar dimensions, number of seats, number of doors and main characteristics.

H) “Rental Price” – the price for use of the vehicle for a period of 24 hours, as stated in the Price List, on the website, on the partner platform or in the Individual Agreement.

I) “Fee/Extra” – an additional amount, separate from the Rental Price, payable for an additional service, option or action by EasyRent.

J) “Coverage” – a contractual additional service offered by EasyRent and selected by the Renter from the available levels “Good Coverage”, “Extended Coverage” and “Premium Coverage”. The specific rights, limitations and exclusions for each level are set out in Section VIII. The Coverages do not constitute an insurance product.

K) “Price List” – the current list of additional services, extras, fees and applicable prices.

II. RENTER REQUIREMENTS AND REQUIRED DOCUMENTS

4. The Renter must present a valid driving licence for the relevant category, valid for at least one month after the end of the rental period, as well as a functioning credit card with an available limit not lower than the amount of the deposit and valid for at least six months after the end of the rental period. Where applicable law requires an International Driving Permit, the Renter must also present such a permit.

5. The Renter shall present a valid identity document – identity card or passport – valid for at least one month after the end of the rental period.

6. The minimum age for renting without an additional fee is 25 years for economy, intermediate, large, estate and minivan classes and 30 years for luxury, premium, special and SUV/4x4 classes.

7. Renters aged between 18 and 25 years, over 65 years, as well as persons with less than 3 years of driving experience, shall additionally pay:

A) a “Young Driver” fee – EUR 10.00 for each rental day;

B) the fee for the applicable mandatory Coverage level, determined according to the vehicle class;

C) a triple deposit.

8. A minimum of 6 months’ driving experience is required for economy, intermediate, large, estate and minivan classes, and a minimum of 5 years for luxury, premium, special and SUV/4x4 classes.

9. EasyRent may refuse a reservation and/or provision of the vehicle where a presented document does not meet the requirements, is invalid, damaged, illegible or gives rise to reasonable doubts as to its validity or regularity.

III. RESERVATION, CANCELLATION AND EXTENSION OF THE RENTAL PERIOD

10. The Renter may reserve a vehicle through the online platform on the EasyRent website, through a partner online platform for rent-a-car services, by telephone or at a company office. An online reservation shall be deemed confirmed upon receipt of electronic confirmation of payment or when the confirmation conditions under the rules of the relevant platform have been met.

11. When making a reservation at an EasyRent office, as well as when collecting a vehicle under an online reservation, the Renter shall enter into an Individual Agreement specifying the vehicle, registration number, rental period, Rental Price, condition of the vehicle and any applicable additional terms. These General Terms and Conditions form an integral part of the Individual Agreement.

12. The minimum rental period is 24 hours. A vehicle may be provided for a shorter period only with prior approval by EasyRent, in which case the Rental Price for a full 24-hour period shall be payable. The same rule shall apply when the rental is extended by only a few hours.

13. An extension may be requested through the website or at an EasyRent office no later than one day before the expiry of the current rental period. The extension may be documented by an entry in the Individual Agreement, an annex or a new agreement. The price for the extended period shall be determined according to the current Price List on the date of payment. Where a specific Coverage level has been selected or is mandatory for the rental, the relevant Coverage shall also apply to the extended period and shall be charged according to the current Price List.

14. Where the extension includes use of the vehicle outside the Republic of Bulgaria, a fee of EUR 20.00 shall be charged for extending the validity of the power of attorney by up to 7 days. For an extension exceeding 7 days, the Renter shall also pay all fees and expenses for reissuing the power of attorney, as well as a new one-off cross-border travel fee in accordance with the Price List.

15. Upon an approved extension, the Renter must pay the new Rental Price and all applicable fees on the same day. The deposit may not be used to cover the Rental Price for the extended period and must remain in full for the entire term. Following payment, the required documents shall be made available at the relevant office. The Renter must collect and sign them where necessary.

16. EasyRent has the right to refuse an extension of the rental period. In such case, the Renter must return the vehicle at the agreed time and place.

17. A confirmed and paid reservation may be changed or cancelled free of charge up to 48 hours before the scheduled collection time. For reservations made through the EasyRent website, any refundable amount shall be returned within up to 20 business days.

17.1. In the event of cancellation between 48 and 24 hours before the scheduled collection time, where the reservation was made through the EasyRent website, the prepaid amount may be credited to the Renter’s electronic wallet and used for a future reservation. EasyRent shall not owe interest, damages or any other compensation for the period during which the amount remains in the wallet. Amounts in the wallet are not redeemable for cash.

18. In the event of cancellation less than 24 hours before the scheduled collection time, the prepaid reservation amount is non-refundable.

18.1. If the Renter fails to appear within 1 hour after the scheduled collection time without prior notice of delay, the reservation shall be deemed cancelled and all prepaid amounts shall be non-refundable.

19. Where the reservation is made through a partner online platform, the terms for changes, cancellation and refund of prepaid amounts shall be governed by the rules of the relevant platform.

20. EasyRent may refuse a confirmed reservation where it is objectively impossible to provide the requested vehicle or a Vehicle of a Similar Class. In such case, the amount paid shall be refunded in full. This shall not affect any rights of the Renter that may not be limited or excluded under applicable law.

21. EasyRent may refuse to provide a vehicle in the event of improper, aggressive, dangerous or manifestly inadequate behaviour by the Renter, as well as where there are objective and reasonable grounds to believe that the agreement will not be duly performed. In such case, the reservation amount shall be refunded unless these General Terms and Conditions expressly provide otherwise.

IV. COLLECTION AND RETURN OF THE VEHICLE

22. The vehicle shall be handed over in technically sound condition, together with the equipment required by law and any additionally requested equipment. The condition of the vehicle and equipment shall be described in the Individual Agreement and/or a handover report. By signing, the Renter confirms that they are aware of the recorded pre-existing damage.

23. EasyRent offices at Sofia Airport, Varna Airport and Burgas Airport operate 24/7. For service between 21:00 and 08:00, an “Out-of-Hours” fee of EUR 25.00 shall be charged for each separate action: collection and/or return.

Example: for collection at 23:00 and return at 05:00, two “Out-of-Hours” fees shall be charged – EUR 50.00 in total.

23.1. For service on a day declared an official public holiday in the Republic of Bulgaria, an additional fee of EUR 25.00 shall be charged for each separate action, regardless of the time. The public holiday fee is separate and may be charged simultaneously with the “Out-of-Hours” fee.

Example: for collection at 22:00 on an official public holiday and return at 07:00 on the following day, which is also an official public holiday, a total of four fees shall be charged – EUR 100.00 in total.

24. The opening hours of the other offices are published on the website and/or displayed on site. For pre-approved service outside those hours, EUR 25.00 shall be charged for each separate action – collection and/or return.

25. EasyRent does not have its own offices outside the Republic of Bulgaria and does not use the offices of other companies as its own offices for providing the service.

26. Where EasyRent provides a Vehicle of a Similar Class or offers, at no additional charge, a vehicle of a higher class, this shall constitute due performance of the reservation. If the Renter refuses the offered vehicle solely because of a difference in make, model or higher class, prepaid amounts shall not be refunded.

27. The right to a replacement vehicle in the event of a covered event shall be available only where included in the selected Coverage level under Section VIII. Under “Premium Coverage”, the Renter shall have priority for a replacement vehicle, subject to availability. In the event of a technical failure due to a defect or normal wear and tear, EasyRent may provide a replacement vehicle regardless of the cause of the failure. If the failure is caused by a culpable act or omission of the Renter and the case is not covered, the costs of replacement and repair shall be borne by the Renter.

28. The prepaid reservation amount is non-refundable and the vehicle shall be released from the reservation where:

A) the Renter fails to appear within 1 hour after the scheduled time without prior notice or without providing a flight number, where applicable;

B) the reservation has not been cancelled within the time limits set out in the General Terms and Conditions;

C) the Renter fails to present a required document or the document is invalid, damaged, illegible or does not meet the requirements;

D) the Renter refuses to pay the Rental Price, the deposit and/or requested services;

E) the Renter does not have a valid credit card in their own name with sufficient available limit, where such a card is required;

F) in other expressly provided cases.

29. If the vehicle is returned before expiry of the agreed period at the Renter’s request, EasyRent shall not refund any amounts for the unused remainder.

30. Tickets and/or cards for access to airport car parks may be used only for their intended purpose for collection and/or return of the vehicle. In the event of unauthorised or excessive parking, the Renter shall reimburse EasyRent for the full amount of any additionally charged fees or penalties.

31. The vehicle shall be returned to the office from which it was collected. Return to another office is possible only upon a request made no later than 24 hours before the agreed return time, express approval by EasyRent and payment of the applicable one-way rental fee.

32. Where the vehicle is returned to a car park, it must be parked only in a space designated for EasyRent or in a space indicated by an employee.

33. The Renter must return the vehicle in the same condition and with the same equipment as when it was handed over, except for normal wear and tear. In the event of missing items or damage, the Renter shall owe compensation. The Renter’s refusal to sign the inspection report shall not prevent the condition of the vehicle from being established and documented. EasyRent has the right to document identified damage and/or missing items by photographs and/or video, data from the vehicle’s electronic systems, witness statements and other admissible evidence. In the Renter’s absence or refusal to attend without valid reason, the findings may be made unilaterally by EasyRent and duly documented.

33.1. For rentals lasting from 1 to 5 days inclusive, the Renter must return the vehicle washed and standardly cleaned inside and out. In the event of non-compliance, a cleaning fee of EUR 25.00 shall be charged. This requirement shall not apply where “Premium Coverage” has been selected, under which standard exterior and interior cleaning after return is included regardless of the rental period. Specialized cleaning under Clause 42 is not included in any Coverage level.

33.2. For reservations without selected Coverage, regardless of the rental period, a “Vehicle Preparation” fee of EUR 25.00 shall be charged.

34. The vehicle shall be returned with the same amount of fuel. If the fuel level is lower, a fee of EUR 15.00 plus the missing fuel at EUR 2.00/litre shall be payable. No refund shall be made for excess fuel.

35. The vehicle shall be handed over only to a duly identified EasyRent employee or by another expressly approved method. If handed over to an unauthorised person, the Renter shall bear full responsibility for the consequences until actual acceptance by EasyRent.

V. OPERATING REQUIREMENTS. USE OUTSIDE THE REPUBLIC OF BULGARIA

36. The Renter must exercise the care of a prudent owner, drive the vehicle only when in a condition allowing safe driving, and must not drive under the influence of alcohol, narcotic, intoxicating or other substances. The Renter must comply with all applicable road traffic rules.

37. The vehicle may be used within the territory of the Republic of Bulgaria. Use outside the country is permitted only with EasyRent’s prior express consent and subject to compliance with the applicable conditions and fees.

38. Driving the vehicle outside the Republic of Bulgaria is permitted only upon prior request and express approval by EasyRent and subject to simultaneous fulfilment of the following conditions:

A) minimum rental period of 7 days;

B) provision, at least 3 days in advance, of information about the countries the Renter wishes to visit;

C) a one-off fee of EUR 75.00–120.00 for the first country, depending on the vehicle class, and EUR 35.00 for each subsequent country;

D) a triple deposit provided by credit card;

E) mandatory selection and payment of the applicable Coverage level determined by EasyRent according to the vehicle class and the conditions of travel outside the country.

39. If the vehicle is found to have left or an attempt is made to leave the territory of the Republic of Bulgaria without EasyRent’s prior written permission, the Renter shall owe a contractual penalty in an amount equal to the standard security deposit for the respective vehicle. EasyRent has the right to terminate the agreement immediately and demand return of the vehicle. In the event of termination due to such a breach, prepaid amounts for the remaining rental period shall not be refunded.

40. When using the vehicle outside Bulgaria, the Renter should not use systems and services that generate additional mobile roaming or internet traffic unless EasyRent has expressly authorised this. All additional costs charged by a mobile operator shall be borne by the Renter.

41. Smoking, consumption of alcoholic beverages in the vehicle, use, possession or transport of narcotic, intoxicating, prohibited or other illegal substances, driving after consuming alcohol or such substances, as well as transporting pets, are prohibited. No Coverage level shall apply to damage, costs, fees, contractual penalties or other liabilities arising in connection with such breaches. In the event of an established breach, the Renter shall owe a contractual penalty in an amount equal to the standard security deposit for the respective vehicle and shall be liable for the damage caused in accordance with these General Terms and Conditions.

42. EasyRent provides the vehicle in a clean condition. If the vehicle is returned heavily soiled, including heavily soiled upholstery, significant amounts of sand, mud, stains, spills, strong odours or other soiling beyond what is usual from normal use, the Renter shall owe a specialized cleaning fee of EUR 200.00. Specialized cleaning is not included in any Coverage level, including “Premium Coverage”.

43. It is prohibited to use the vehicle for races or training; towing another vehicle or trailer; carrying loads outside the vehicle’s normal intended use; driving outside the national road network, off-road or on unpaved roads. No Coverage level shall apply to damage, loss, costs or other liabilities arising in connection with such use. In the event of an established breach, the Renter shall owe a contractual penalty in an amount equal to the standard security deposit for the respective vehicle. Where the breach causes damage, costs or losses exceeding the amount of the contractual penalty, EasyRent has the right to claim compensation for the difference up to the full amount of the damage actually caused.

44. In the event of an incident, road traffic accident, damage, theft, fire, compulsory seizure or detention of the vehicle, suspension from use, termination of registration or any other event restricting or preventing its normal use, the Renter must immediately notify EasyRent, remain at the scene where necessary, notify the competent authorities and obtain a report or other official document. The Renter must disclose all known facts and information, including details of witnesses, and provide full cooperation.

44.1. The Renter must take all reasonable and necessary measures to safeguard the vehicle and to limit and mitigate the damage.

44.2. At their own expense, the Renter must obtain all additional documents requested by EasyRent and submit them within 3 days of the event, and upon request make the vehicle available for inspection and photography no later than the third day.

44.3. The Renter must cooperate in establishing the circumstances of the event and the amount of damage. Incorrectly completed documents or documents submitted after the specified deadline may be treated as not submitted where, as a result, they cannot serve the purpose for which they were required.

44.4. Where the incident or breach is caused through the fault of the Renter and the vehicle cannot be used in EasyRent’s commercial activity, the Renter shall owe compensation equal to the Rental Price for the period during which the vehicle cannot be used, as well as reimbursement of all directly related additional costs.

45. The Renter has no right to carry out or commission repairs without EasyRent’s prior express consent, except where immediate action is necessary to prevent greater damage and prior consent objectively cannot be obtained.

46. In the event of a punctured or damaged tire, the Renter must immediately notify EasyRent and follow the instructions given. Under “Good Coverage”, “Extended Coverage” or where there is no Coverage, the costs of repair or necessary replacement shall be borne by the Renter. Under “Premium Coverage”, covered tire damage shall be covered in accordance with Section VIII, provided that none of the general exclusions applies.

47. The Renter must monitor warning indicators and operating fluid levels, including oil and coolant, and upon any indication of need must immediately notify EasyRent and follow the instructions given.

48. When leaving the vehicle, the Renter must switch off the lights, headlights, radio and other electrical consumers where applicable, lock the vehicle and must not leave the vehicle documents unattended inside it.

VI. DELAY IN RETURNING THE VEHICLE

49. The Renter must return the vehicle at the agreed time and place.

50. For a delay of up to 1 hour, the Renter shall not owe an additional Rental Price.

51. For a delay exceeding 1 hour, the Renter shall owe the Rental Price under the Individual Agreement for one day, increased by 20%. If the delay continues for more than 24 hours, this amount shall be payable for each commenced subsequent 24-hour period. For a delay exceeding 24 hours for which there is no pre-approved extension of the rental period, the Renter shall additionally owe a contractual penalty in an amount equal to the standard security deposit for the respective vehicle. The contractual penalty shall not release the Renter from the obligation to pay the Rental Price due for the period of delay, as well as any damage caused to EasyRent exceeding the amount of the contractual penalty.

52. If the vehicle is not returned within 72 hours after the agreed time and there is no approved extension, EasyRent may refer the matter to the competent authorities for actions to establish the location of and trace the vehicle. For the administrative processing and actions related to such referral, the Renter shall owe an administrative fee of EUR 100.00 in addition to the amounts under the preceding provisions.

VII. PAYMENTS, DEPOSITS AND RELEASE OF FUNDS

53. The Renter must pay all amounts provided for in the General Terms and Conditions, the Individual Agreement and the Price List, including the Rental Price, fees, contractual penalties, compensation and other amounts due.

54. The Price List is available on the EasyRent website and/or displayed prominently in the offices. By accepting the General Terms and Conditions and/or signing the Individual Agreement, the Renter confirms that they have had the opportunity to review it.

55. All amounts shall become due on the day on which the grounds for payment arise, unless expressly agreed otherwise. In the event of delay, the applicable contractual penalties and/or statutory compensation shall be due.

56. For reservations made through the EasyRent website or a partner platform, the Renter shall pay a reservation amount in the amount and under the conditions specified on the relevant platform.

57. Upon collection, the Renter shall pay the Rental Price, the required deposit and all requested additional services not included in the Rental Price. Where a reservation amount has been prepaid, it shall be deducted in accordance with the reservation terms.

58. The Rental Price includes unlimited mileage, compulsory Motor Third Party Liability insurance, local motor vehicle tax and a vignette for the Republic of Bulgaria, where applicable. It does not include fuel, fines, penalties, additional services or other amounts arising in connection with use of the vehicle.

59. Payment may be made by credit card or bank transfer. EasyRent offices are equipped with POS terminals. Payment in cash or by debit card is permitted only with EasyRent’s express consent and subject to applicable legal and platform restrictions.

60. Online payments may be made via Visa/Mastercard, PayPal, where available, or by bank transfer.

61. If the vehicle is changed at the Renter’s request to a vehicle of a lower class, the price difference shall not be refunded.

62. Unless otherwise provided for the selected Coverage level, the deposit shall be provided by a Visa or Mastercard credit card issued in the Renter’s name and meeting EasyRent’s requirements regarding validity and available limit. The standard deposit amount depends on the vehicle class and may range from EUR 100.00 to over EUR 2,000.00. When “No Coverage” is selected, a deposit equal to three times the standard deposit is required. Under “Good Coverage” and “Extended Coverage”, the standard deposit is required. Under “Premium Coverage”, no standard security deposit for the vehicle is required, except for any applicable additional guarantee for vehicles of increased value or risk pursuant to Clause 73.3(A). This does not release the Renter from obligations not included in the Coverage.

63. In the event of a lost key, lost documents, registration plates, missing parts or other EasyRent property due to the Renter’s fault, the Renter shall owe compensation up to the full amount of the costs of restoration or replacement, as well as rent for each day during which the vehicle is out of service, including where this amount exceeds the deposit.

64. The deposit shall be released after inspection of the returned vehicle and, provided there are no breaches or outstanding obligations, within up to 20 business days from the return. Where an additional request to a bank is required due to a missing/not presented authorisation receipt or another reason attributable to the Renter, a fee of EUR 10.00 may be charged. The period for actual release by the bank depends on the relevant institution.

65. Where a deposit is required under the selected Coverage level, providing it in cash or by debit card is permitted only with EasyRent’s express approval. EasyRent may refuse such a method of providing the deposit and accordingly refuse to provide the vehicle.

66. The deposit shall be subject to release/refund if the Renter has no outstanding obligations that may be set off against or covered by it under the agreement or the General Terms and Conditions.

67. By accepting the General Terms and Conditions, the Renter expressly agrees that:

A) the deposit or part thereof may be used to cover amounts due under the agreement; where the deposit is insufficient, the remaining balance shall remain payable;

B) amounts due arising in connection with the rental, including fines, tickets, damage and other subsequently established obligations, may be collected through the payment instrument provided where there is a valid payment basis and in accordance with the rules of the relevant payment operator.

68. Card transactions are processed using the applicable security mechanisms, including Mastercard Identity Check and Visa Secure.

69. For security reasons, the maximum amount for a single card payment through the relevant online channel may be limited to EUR 5,112.92.

70. EasyRent does not store full bank card details used for payment through the website, except for data processed by a licensed payment service provider in accordance with the applicable rules.

71. Where an amount paid by bank card is refunded, the refund shall be made to the same card used for the original payment, unless applicable payment rules or law require otherwise.

VIII. ADDITIONAL COVERAGE SERVICES

72. General Rules for Coverage

72.1. EasyRent offers contractual additional coverage services at different levels. The Coverages do not constitute an insurance product and do not replace compulsory or voluntary vehicle insurance. They limit the Renter’s financial liability and/or include additional services only within the scope expressly provided for the selected level and subject to compliance with these General Terms and Conditions.

72.2. The available levels are “Good Coverage”, “Extended Coverage” and “Premium Coverage”. The Renter may select an applicable level when making the reservation or entering into the Individual Agreement, unless EasyRent has determined a mandatory minimum level for a specific vehicle, driver, route or rental conditions. The price of the relevant Coverage shall be determined according to the current Price List and/or displayed during the reservation process and does not form part of these General Terms and Conditions.

72.3. The “No Coverage” option is not a Coverage level. Under this option, the Renter does not benefit from the rights under this Section, bears full contractual and property liability for uncovered damage, loss and costs in accordance with the General Terms and Conditions, an increased deposit under Clause 62 is required, and a replacement vehicle, roadside assistance and waiver of the administrative fee in the event of an accident or incident are not included.

72.4. No Coverage level releases the Renter from the obligation to comply with the General Terms and Conditions, the Individual Agreement and applicable law. Where an exclusion or breach under Clause 74 applies, the relevant Coverage shall not apply to the resulting damage, loss, costs, fees, contractual penalties, sanctions and other obligations.

73. Rights According to the Selected Coverage Level

73.1. “Good Coverage” includes:

A) limitation of the Renter’s financial liability in the event of a covered event – damage, road traffic accident or theft – to the amount and subject to the conditions stated at the time of reservation, in the Individual Agreement and/or the Price List;

B) a standard security deposit instead of the increased deposit applicable when “No Coverage” is selected.

“Good Coverage” does not include: damage to tires, rims and vehicle windows; a replacement vehicle in the event of a covered event; roadside assistance in the event of an incident; waiver of the administrative fee in the event of an accident or incident; or waiver of the applicable requirements to return the vehicle washed and standardly cleaned.

73.2. “Extended Coverage” includes:

A) significant limitation of the Renter’s financial liability in the event of a covered event – damage, road traffic accident or theft – to the amount and subject to the conditions stated at the time of reservation, in the Individual Agreement and/or the Price List;

B) refund/release of the standard security deposit in the event of a covered event, subject to compliance with the conditions of this Section and provided there are no other outstanding obligations;

C) a replacement vehicle in the event of a covered road traffic accident, damage or theft where the vehicle cannot be used, subject to availability and EasyRent’s operational capacity;

D) free roadside assistance in the event of a covered incident within the territory of the Republic of Bulgaria;

E) waiver of the standard administrative fee for processing a covered road traffic accident or incident.

“Extended Coverage” does not include damage to tires, rims and vehicle windows, nor does it include waiver of the applicable requirements to return the vehicle washed and standardly cleaned.

73.3. “Premium Coverage” includes all rights under “Extended Coverage”, as well as:

A) no standard security deposit is required for the vehicle. For vehicles in the luxury, special and/or any other class involving increased value or risk, EasyRent shall be entitled to require an additional guarantee, irrespective of the selected “Premium Coverage”. The amount and method of providing the additional guarantee shall be determined by EasyRent for the specific vehicle and shall be stated at the time of booking and/or in the Individual Agreement. The additional guarantee does not constitute an excess/deductible and its existence does not alter the Renter’s rights under “Premium Coverage”. This does not release the Renter from obligations relating to amounts and cases not included in the Coverage, and EasyRent may require a valid payment instrument in accordance with these General Terms and Conditions;

B) for covered damage to tires, rims and vehicle windows, the Renter shall owe no excess for repair or replacement, subject to compliance with the conditions of this Section;

C) priority in the provision of a replacement vehicle in the event of a covered event, subject to availability;

D) the Renter shall not owe compensation for loss of use for the period during which the vehicle is out of service as a direct consequence of a covered event. This waiver shall not apply in the event of a breach, exclusion or other culpable act/omission by the Renter outside the scope of the Coverage;

E) the vehicle is not required to be returned washed and standardly cleaned, regardless of the rental period. Standard exterior and interior cleaning after return is included, but specialized cleaning under Clause 42 is not included.

74. Conditions of Application and General Exclusions

74.1. The Renter may benefit from the rights under the selected Coverage only if all applicable requirements are fulfilled, including:

A) in the event of an incident or road traffic accident, immediately notify EasyRent and, where necessary, the competent authorities, and provide a duly issued document within the time limit specified by EasyRent;

B) in the event of theft, fire or total loss, provide all required documents from the competent authorities and not have left the vehicle keys and/or documents unattended;

C) comply with road traffic rules and all obligations under these General Terms and Conditions;

D) the vehicle must be driven only by the Renter or by a Driver duly entered in the Individual Agreement;

E) provide full cooperation in establishing the event, its causes and the amount of damage.

74.2. Regardless of the selected level, the Coverage shall not apply and the Renter shall bear full liability for damage, loss, costs, fees, contractual penalties, sanctions and other obligations arising directly or indirectly in connection with:

A) smoking in the vehicle;

B) transporting pets;

C) consumption of alcoholic beverages in the vehicle, driving after consuming alcohol, as well as the use, possession or transport of narcotic, intoxicating, prohibited or other illegal substances;

D) driving outside the national road network, off-road or on unpaved roads, as well as using the vehicle for races, training, towing or other prohibited use under Clause 43;

E) fines, tickets, road and parking charges, sanctions, administrative processing costs and other consequences of breaches of road traffic rules or applicable law;

F) driving by a person who is not registered as an authorised Driver in the Individual Agreement;

G) intentionally caused damage, gross negligence, unlawful activity or use of the vehicle in breach of Clause 83;

H) lost or damaged keys, documents, registration plates, missing parts, accessories or equipment;

I) damage to the interior, upholstery, dashboard, seats and other interior elements, unless EasyRent has expressly confirmed otherwise in the Individual Agreement;

J) use of unsuitable fuel, incorrect refuelling, failure to respond to warning indicators or other cases under Clause 79;

K) unauthorised departure or attempted departure from the Republic of Bulgaria, as well as breach of the conditions for using the vehicle outside the country;

L) specialized cleaning under Clause 42, including excessive soiling, stains, spills, strong odours or other contamination requiring additional treatment.

74.3. Damage to tires, rims and vehicle windows is outside the scope of “Good Coverage” and “Extended Coverage” and is included only under “Premium Coverage” subject to Clause 73.3 and provided that no general exclusion under Clause 74.2 applies.

74.4. The waiver of the administrative fee for a covered road traffic accident or incident under “Extended Coverage” and “Premium Coverage” does not include administrative fees for fines, tickets, road or parking violations, unauthorised use, late return or other contractual breaches.

74.5. The existence of Coverage does not limit EasyRent’s right to collect from the Renter all amounts outside the scope of the selected Coverage or arising as a result of a breach of the General Terms and Conditions, the Individual Agreement or applicable law.

IX. LIABILITY, CONTRACTUAL PENALTIES AND COMPENSATION

75. EasyRent shall not be liable for false, incomplete or inaccurately displayed information independently entered, amended or published by the operator of a partner rent-a-car platform and not originating from EasyRent. EasyRent shall be responsible for information that the company itself has provided to the relevant platform.

76. EasyRent shall not be liable for acts or omissions of banks, card operators and payment institutions in blocking, unblocking, authorisation, purchases or release/refund of amounts, including the period during which an amount remains unavailable, where the delay is not attributable to EasyRent.

77. The Renter must use the vehicle for its intended purpose and maintain it in the condition in which it was handed over, allowing for normal wear and tear. For additional services provided or administrative actions performed, the Renter shall owe the relevant fees; for breach of a contractual obligation – the stipulated contractual penalty; and for damage caused – compensation in accordance with the General Terms and Conditions and applicable law. Where the damage caused exceeds the amount of the agreed contractual penalty, EasyRent has the right to claim compensation for the damage exceeding the amount of the contractual penalty where the statutory requirements are met.

78. In the event of a material breach of the General Terms and Conditions or the Individual Agreement, including unauthorised use of the vehicle, driving by an unregistered driver, unauthorised departure from the country, overdue return or use creating a risk of damage, loss or seizure of the vehicle, EasyRent has the right to terminate the agreement with immediate effect and demand immediate return of the vehicle. In the event of non-compliance, EasyRent has the right to take the actions permitted by law to recover possession of the vehicle. Prepaid amounts for the unused remainder of the rental period shall not be refunded.

79. The Renter shall be fully liable for damage caused by:

A) use of unsuitable or poor-quality fuel, oil or other consumables where this was done by the Renter or on the Renter’s instructions;

B) refuelling with the wrong type of fuel;

C) failure to respond to a warning indication of a critically low level of oil, coolant or other operating fluid.

Where, as a result of such a breach, the engine is severely damaged or seized and repair/replacement is economically unjustified compared with the value of the vehicle, the Renter shall be liable up to the amount of the damage actually caused, including up to the insured value of the vehicle, where the statutory requirements are met.

80. In the event of a lost ticket and/or access card for a public airport car park, the Renter shall owe a contractual penalty of EUR 50.00.

81. All fines, tickets, road and parking charges, sanctions and related expenses arising from violations during use of the vehicle shall be entirely for the account of the Renter/Driver and are not covered by any Coverage level. An administrative fee of EUR 55.00 shall be payable as remuneration for processing each separate violation and is separate from the amount of the fine, sanction, road or parking charge. The waiver of an administrative fee for a covered road traffic accident or incident under Section VIII shall not apply to the administrative fee for processing fines, tickets, road and parking violations. EasyRent shall notify the Renter using the available contact details.

82. Where the vehicle cannot be used as a result of a culpable act or omission by the Renter (registration plates seized by the Traffic Police, lost registration plate(s), incorrect fuel, lost key or documents, seized engine, etc.), the Renter shall owe compensation for the period during which the vehicle cannot be used, calculated on the basis of the Rental Price under the Individual Agreement. Under “Premium Coverage”, such compensation shall not be due only where the loss of use is a direct consequence of a covered event and there is no breach or exclusion under Section VIII.

83. It is prohibited to use the vehicle to carry out or facilitate unlawful activity, including transporting persons in breach of applicable immigration law, transporting prohibited substances and illegal items. No Coverage level shall apply to damage, costs, sanctions or other obligations arising in connection with such activity. In the event of an established breach, EasyRent has the right to terminate the agreement immediately, and the Renter shall owe a contractual penalty in an amount equal to the standard security deposit for the respective vehicle, without limiting the Renter’s liability for damage exceeding that amount.

84. Where the vehicle is destroyed or stolen and, due to the Renter’s failure to comply with a statutory or contractual obligation – including loss of or leaving unattended keys or documents required to submit an insurance claim – the insurer refuses to pay compensation, the Renter shall be liable for the damage caused up to the insured value of the vehicle.

85. In the event of new damage other than theft or total loss, the Renter’s financial liability may be limited in accordance with the selected Coverage level, the Individual Agreement or the terms of the platform through which the reservation was made. The limitation shall not apply in the event of a breach or exclusion under Section VIII.

86. The Renter and the Driver shall be jointly and severally liable for obligations which, under the Individual Agreement and these General Terms and Conditions, apply to both of them, including damage caused and recoverable costs of collecting amounts due.

X. PERSONAL DATA PROTECTION

87. In connection with the conclusion and performance of the Individual Agreement and provision of the services, EasyRent processes personal data of the Renter, the Driver and, where applicable, other persons. The categories of data, purposes, legal bases and retention periods are described in the Personal Data Protection Policy available at: https://easyrentbulgaria.bg/informaciq/politika-za-zashtita-na-lichnite-danni.

88. EasyRent processes personal data in its capacity as controller under the conditions and on the legal bases set out in applicable law and the Personal Data Protection Policy. The Policy also contains information about the rights of data subjects.

89. The Renter has the right to request a paper copy of the Personal Data Protection Policy. By accepting the General Terms and Conditions, the Renter confirms that they have been given the opportunity to review the Policy.

XI. FINAL AND ADDITIONAL PROVISIONS

90. The General Terms and Conditions shall become binding on the Renter upon acceptance during an online reservation by ticking the relevant box or, for a reservation/conclusion of an agreement at an office, where acceptance is evidenced by a signature or another permissible method.

91. The General Terms and Conditions, the Individual Agreement, appendices, annexes and other documents related to the rental relationship may be signed in the following ways:

91.1) by handwritten signature on paper;

91.2) by a simple or advanced electronic signature within the meaning of Regulation (EU) No 910/2014 (eIDAS), including a signature made with a stylus on a tablet or other electronic device where the signature is logically associated with the relevant electronic document;

91.3) the Parties expressly agree to give the simple or advanced electronic signature used between them a value equivalent to a handwritten signature, in accordance with applicable Bulgarian and European legislation;

91.4) documents electronically signed in the agreed manner shall be deemed documents in written form and may be stored and reproduced electronically;

91.5) the Parties shall not contest the evidential value of a document solely because of its electronic form or electronic signature;

91.6) the Individual Agreement, the General Terms and Conditions and the appendices and pricing terms expressly incorporated therein shall govern the legal relationship for the specific rental.

92. The Individual Agreement and the General Terms and Conditions shall be governed by the law of the Republic of Bulgaria.

93. Disputes shall be resolved by mutual agreement and, where this is not possible, by the competent court. In the event of discrepancies between language versions, the Bulgarian-language text shall prevail for the purposes of interpreting the contractual terms. This shall not limit mandatory consumer rights under applicable law. Electronic communications and documents may be used as evidence in accordance with procedural law.

94. EasyRent has the right to amend and supplement these General Terms and Conditions at any time. The new version shall be published on the website with the stated effective date and shall apply to reservations and agreements concluded after that date. For agreements already concluded, the version of the General Terms and Conditions accepted by the Renter at the time of conclusion shall apply, unless the amendment is expressly agreed between the parties or results from a mandatory legislative change. Where the law requires individual notification, it shall be made by e-mail, SMS or another channel provided by the Renter.

95. Correspondence shall be carried out using the addresses and contact details specified in the agreement and reservation, including by e-mail. A message received after 17:00 Bulgarian time may be deemed received on the next business day where a contractual time limit begins to run from the time of receipt. Each party must promptly notify the other of any change to its contact details.

96. All matters not regulated herein concerning the conclusion, performance, non-performance and interpretation of the Individual Agreement and the General Terms and Conditions shall be governed by the legislation of the Republic of Bulgaria.

97. Disputes shall be referred for resolution to the competent Bulgarian court in accordance with the applicable rules on subject-matter and territorial jurisdiction, including consumer protection rules where applicable.
